First Amendment to Amended and Restated Declaration of Covenants, Conditions, and Restrictions

This First Amendment was made pursuant to the authority granted to the Declarant in Section 6.7 of the Declaration. It amends three areas: adding dock easement rights across the Vegetated Natural Buffer, clarifying the scope of the VNB restrictions, and correcting the Declarant's state of domicile.

§ 1 Dock Easements New Provision
What Changed
A new subsection 1.10(c) was added to the Easements section of the Declaration. It grants each lot owner a limited easement across the Vegetated Natural Buffer (VNB) specifically to access Holly Lake or Seacoast Lake for purposes of constructing or accessing a private pier or dock.
New Language — § 1.10(c) Dock Easements Each Lot shall convey to its respective Owner a non-exclusive, permanent and perpetual easement over and across that portion of the Vegetated Natural Buffer Reservation (the “VNB”) between each Owner's Lot and Holly Lake or Seacoast Lake for purposes of access, egress, and ingress from each Lot, over the VNB, and to the lakefront adjacent to each Lot. The express and sole purpose of this easement is to allow the Owners to cross the VNB to access the high water line of the lake to construct and access a private pier or dock into the lakes in accordance with the authority provided to the Owners in Section 1.9.

Key conditions and limitations on the dock easement:

  • Each easement shall be no more than 20 feet in width, centered as best as possible along the width of the Lot to minimize encroachment onto neighboring easements
  • Owners may make minor, non-intrusive additions within the easement for access to the lakefront (e.g., pavers or stepping stones)
  • The location of each easement and all alterations within it must be approved in advance by the ACC
  • Work or access improvements within the easement shall not impede or infringe upon any other Owner's use of the VNB and Common Areas
  • No Owner shall damage, impair, substantially alter, or otherwise impact the VNB
  • Owners are liable to the Association or neighboring owners for any damage or impairment of the VNB done in exercise of these rights
  • Neither the Declarant nor the Association bears any liability for any Owner's action or inaction with respect to any easement granted herein

§ 2 Vegetated Natural Buffer Reservation Section Updated
What Changed
A clarifying sentence was added to the end of Section 3.8 (Vegetated Natural Buffer Reservation) to make clear that the VNB's duties and obligations are subject to the new dock easement rights granted in § 1.10(c).
Added Language — End of § 3.8 “The duties, obligations, and requirements provided in this Section are subject to the limited rights granted to each Owner under section 1.10(c) above.”

This means the VNB's general prohibition on construction, development, or improvement does not prevent an owner from exercising their dock easement rights under the new § 1.10(c), provided all ACC approvals are obtained.


§ 3 Domicile of Declarant Correction
What Changed
The original Declaration incorrectly identified Seacoast Estates, LLC as a Delaware limited liability company. This amendment corrects all references to accurately reflect that Seacoast Estates, LLC is a Florida limited liability company.

All references in the Declaration describing the Declarant as a Delaware limited liability company are hereby replaced to correctly describe the Declarant as a Florida limited liability company. This is a clerical correction only and does not affect any substantive rights or obligations.


§§ 4–5 Terms & Effect
  • § 4 Terms from Declaration: All capitalized terms in this First Amendment have the same meaning as defined in the Declaration.
  • § 5 Declaration Remains in Effect: Except as amended by this First Amendment, the Declaration remains in full force and effect.
